These terms and conditions (the “Terms & Conditions”) govern the use of emergencyconsult.co.nz (the “Site”). This site is owned and operated by Emergency Consult Ltd. These terms and conditions apply solely to the content of, and the information collected by, this website. By using this site, you indicate that you have read and understand the terms and conditions and agree to abide by them at all times.

Services

This site is a telehealth website. We provide video consultations with a registered medical doctor or registered nurse. You may be provided with prescriptions (or e-prescriptions) or referrals as part of our service.

We provide COVID-care and follow-up calls on behalf of various Primary Health Organisations and District Health Boards. We provide service to the New Zealand public and other healthcare providers (such as aged-care facilities and emergency departments).

We may change, add or remove services without notice.

Our service is designed to provide urgent medical care for cases that are not life or limb threatening. If you require an ambulance, or have symptoms such as severe chest pain or breathlessness, heavy bleeding, broken bones, or loss of consciousness, call 111 or go to an emergency department immediately.

Our service is available at all times; 24-hours, 7-days.

Information Collection, Use and Sharing

We collect your personal contact and health information on this site for the purpose of providing medical care. Please refer to our Privacy Policy for more information on what we collect and how we use it. We will not sell, give or rent your information to anyone without your express permission.

We will use your information to provide responsive medical care to you regarding the reason you contacted us. Your information will only be shared with other healthcare providers as necessary to complete your care e.g. to send a prescription to your nearest pharmacy, to send a referral for investigations or specialist appointment, or to send patient notes to your primary health organisation (PHO) or general practitioner (GP) if instructed to do so.

Eligibility, Overseas Consults, and Enrolment

Emergency Consult services are available to all New Zealand citizens and residents located in New Zealand.

If you are traveling overseas, you are advised to seek medical treatment locally. While many of Emergency Consult's doctors hold international credentials we can not guarantee certification to prescribe medicines in the country in which you are travelling.

Anyone in New Zealand is able to use the site without formal enrollment. You will be asked to complete simple registration in order to initiate the consultation, which does not equate to healthcare provider enrollment. You may use the site as often as you like and you will still remain enrolled with your usual primary health organisation (PHO) or general practitioner (GP). This site is intended for urgent care use; all users are advised to maintain enrollment with a primary care provider.

Consent

By registering and initiating a video consult you are giving consent for our doctor/nurse to “see” and treat you to the best of their abilities. You will be given the option to have the notes from this consultation sent to your regular PHO or GP.

User Responsibilities

When using our service, please ensure that:

1. You follow the advice of our practitioners as closely as possible
2. You follow instructions regarding the use of any medicines or healthcare products we recommend or prescribe (including expiry dates)
3. You report any adverse or unexpected effects of treatments we recommend to you
4. You store any prescribes medicines securely and do not allow others (especially children) to use them.
5. Your information is up-to-date and accurate
6. You use our services only for yourself (or a child or dependent)
7. If you have any issue with our services you contact us directly via the phone number or email address provided on the Contact page of this site.

Registration and Payment

Our service works on a “user-pays” basis and we require payment before the consult takes place. To register, you must provide basic contact information (name, DOB, email and phone number) and financial information (via PayPal or Credit Card processed through third-party gateway. Financial information is used to pre-pay your consult only. If we have trouble processing a payment, we’ll use your contact information to contact you.

When you register on our site, you agree that:

1. You are solely responsible for your account and the security and privacy of your account, including passwords and the information attached to that account.

2. All personal information you provide to us through your account is accurate, up-to-date, and truthful and you will update your personal information if it changes.

Intellectual Property

All content published and made available on our site is the property of Emergency Consult Ltd. This includes, but is not limited to, images, texts, logos, documents, downloadable files and anything that contributes to the composition of our site.

Indemnity

Emergency Consult and our directors, employees and contractors will not be liable for any actions, claims, loses, damages, liabilities and expenses including legal fees from your use of this site.

Applicable Law

These terms and conditions are governed by the laws of New Zealand. Our Privacy Policy is governed by the relevant Privacy Act 2020 and Health Information Privacy Code 2020.

Our practitioners will act in line with current Medical Council guidelines and relevant legislation. All customer prescriptions will be provided at the prescribing practitioner’s discretion.

Severability

If at any time any of the provisions set forth in these terms and conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these terms and conditions. All other provisions will be unaffected and the rest of the terms and conditions will be considered valid.

Changes

These terms and conditions may be amended from time to time in order to maintain compliance with law and reflect changes to our processes. We will notify users of any changes to our terms and conditions by email and post a notice on in our site’s News section.
